词汇 | sound recording copyright |
释义 | `1`sound recording copyright `2` "Nolo Everybody's Legal Dictionary": A work resulting from the fixation of a series of musical or other sounds (including narration or spoken words). The performer, producer, or recording company usually claims copyright in the sound recording. The sound recording copyright is one of two copyrights associated with the music business. The other is the musical work copyright. (A musical work copyright protects the musical composition; a sound recording copyright protects the way that the composition is performed.) Sound recordings were not protected under copyright law until February 1972.For example, Frank Sinatra recorded the song, Yesterday, written by John Lennon and Paul McCartney. Sinatra did not write the song, so he is not entitled to claim copyright for the musical work. However, his unique arrangement and performance of Yesterday is entitled to sound recording copyright. Therefore, the compact disc containing Frank Sinatra's performance contains two copyrightable works: the Sinatra sound recording copyright, and the Lennon McCartney musical work.
