DOYLE ERROR. The precise issue presented in Doyle was whether a prosecutor could use a defendant's post-arrest silence to impeach the defendant's exculpatory testimony. 426 U.S. at 616. The Court held that in light of Miranda's explicit recognition that one has a constitutional right to remain silent, the prosecutor could not use the defendant's decision to exercise that right as a tool of impeachment.
