释义	工地上工伤由包工负责，除包工承担一定责任外，转包方应负有同等的赔偿责任，包工负责人确实无力承担的，由发包方承担。用人单位非法使用临时工期间，造成临时工工伤的，应由用人单位承担临时工的工伤待遇。法律依据：《人力资源和社会保障部关于执行工伤保险条例若干问题的意见》第七条具备用工主体资格的承包单位违反法律、法规规定，将承包业务转包、分包给不具备用工主体资格的组织或者自然人，该组织或者自然人招用的劳动者从事承包业务时因工伤亡的，由该具备用工主体资格的承包单位承担用人单位依法应承担的工伤保险责任。
