民法典定金和违约金如何赔偿

法律分析：定金和违约金同时存在时，当事人只可择其一而行使。依据我国相关法律规定，违约金条款定金条款不可并用。定金不足以弥补一方违约造成的损失的，对方可以请求赔偿超过定金数额的损失。
