释义	法律分析: 若抵押权与质权并存时，区分设立先后确定优先顺序：（1）先设立质权的，质权当然优先于抵押权（2）先设立抵押权的，登记的抵押权优先于质权人受偿。因为即使先基于抵押合同设立的抵押权，若未登记，则不得对抗善意第三人即后设立的质权的质权人，此时质权人也是先于未登记的抵押权人清偿。法律依据: 《中华人民共和国民法典》第四百一十五条同一财产既设立抵押权又设立质权的，拍卖、变卖该财产所得的价款按照登记、交付的时间先后确定清偿顺序。
