退休后再继续竞聘新工作的劳动关系性质
释义
退休后另行竞聘新工作的劳动关系性质属于聘用合同关系。劳动者的身份不同，签订的合同属性也有区别。退休另聘与用人单位之间建立的不是劳动关系而是劳务关系，受民法而不是受劳动法保护。
【法律依据】
《劳动法》第二条
在中华人民共和国境内的企业、个体经济组织和与之形成劳动关系的劳动者，适用本法。
《关于实行劳动合同制度若干问题的通知》第十三条
已享受养老保险待遇的离退休人员被再次聘用时，用人单位应与其签订书面协议，明确聘用期内的工作内容、报酬、医疗、劳保待遇等权利和义务。
