释义	医院抽取脐带血一般是不违法的。但是医院在抽取时应当取得《血站执业许可证》。根据有关规定，医疗机构只能向由国家卫生计生委批准设置，具备《血站执业许可证》的脐带血造血干细胞库采集、提供脐带血。《中华人民共和国献血法》第十八条有下列行为之一的，由县级以上地方人民政府卫生行政部门予以取缔，没收违法所得，可以并处十万元以下的罚款；构成犯罪的，依法追究刑事责任：（一）非法采集血液的；（二）血站、医疗机构出售无偿献血的血液的；（三）非法组织他人出卖血液的。
