法律分析：只能选择一种适用，一般情况下合同违约方是需要返还定金的，现在在外面做事有很多的方面是需要进行签订合同的，而一旦签订了合同之后就必须按照合同上的来算，不可以违反合同上的条例，否则就是属于违约。
法律依据：《中华人民共和国民法典》 第五百八十八条 当事人既约定违约金，又约定定金的，一方违约时，对方可以选择适用违约金或者定金条款。
定金不足以弥补一方违约造成的损失的，对方可以请求赔偿超过定金数额的损失。
