释义	主体要件本罪主体为一般主体，即达到刑事责任年龄具有刑事责任能力的自然人，也可以包括单位。主观要件本罪在主观方面必须有明确的故意，即明知是黑社会性质的组织而积极参加;明知是黑社会性质的组织而组织、领导;如果不了解情况，参加了黑社会性质的组织，事后退出的，可能构成别的罪，而不按本罪追究刑事责任。当然，如果参加时不明知，加入后明知了仍不退出，则应按本罪追究刑事责任。本罪的追求目标是金钱和权力。法律依据《中华人民共和国刑法》第二百九十四条
