和外国人离婚如何办理？

根据法律规定，和外国人离婚可以协议离婚或诉讼离婚。中国人同外国人协议离婚，男女双方应当共同到内地居民常住户口所在地的婚姻登记机关办理离婚登记。中国人同外国人诉讼离婚，一方向有管辖权的法院提起离婚诉讼，由法院进行调解或判决。

《婚姻登记条例》 第十条第二款 中国公民同外国人在中国内地自愿离婚的，内地居民同香港居民、澳门居民、台湾居民、华侨在中国内地自愿离婚的，男女双方应当共同到内地居民常住户口所在地的婚姻登记机关办理离婚登记。
