释义	什么行为是商品房买卖中的欺诈行为，必须严格按照欺诈的法律构成要件来认定。传统民法认为，欺诈是指当事人一方故意编造虚假事实或歪曲事实，使表意人陷入错误，违背真实意思而做的意思表示。构成商品房欺诈须具备四大构成要件： 1、须有隐瞒真相，制造假象的欺诈行为; 2、欺诈行为使当事人陷入错误; 3、须有欺诈故意; 4、实施欺诈之人为相对人或者第三人。开发商的欺诈行为可以表现为无中生有、颠倒黑白的虚假陈述或者误导陈述，也可表现为重大遗漏或者不正当陈述。
