释义	法律分析：抚养权既是权利也是义务，抚养权在法律上是有权利和义务两面性的。民法上的权利义务关系一般都是对等的，但抚养权是例外之一，生父母不对子女尽抚养义务，其亲生子女不能以此为理由不承担赡养义务，抚养权的权利和义务是基于血亲而产生的。法律依据：《中华人民共和国民法典》第一千零六十七条父母不履行抚养义务的，未成年子女或者不能独立生活的成年子女，有要求父母给付抚养费的权利。成年子女不履行赡养义务的，缺乏劳动能力或者生活困难的父母，有要求成年子女给付赡养费的权利。
