释义	律师解答：工资多发了3000不退不算违法，但是用人单位因为工作失误多给劳动者发放了工资，劳动者是没有法律依据的不当得利，没有合法根据，取得不当利益，造成他人损失，用人单位要求退还的，应当退还。【法律依据】：《中华人民共和国民法典》第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿。
