释义	口头承诺是公民、法人为了设立、变更、终止民事权利和义务所实施的合法行为的一种。民事法律行为可以采用书面形式，口头形式或其它形式。因此，可以认定口头承诺具有法律效力，其效力自承诺开始，也就是民事法律行为成立时生效。承诺之人受承诺的约束，除非依照法律规定或对方当事人同意，口头承诺之人不得对自己的承诺随意变更或解除。法律依据：《中华人民共和国民法典》第一百三十五条民事法律行为可以采用书面形式、口头形式或者其他形式；法律、行政法规规定或者当事人约定采用特定形式的，应当采用特定形式。
