问题	诬告陷害罪应当应该怎么处罚？
释义	根据《刑法》第243条第1款的规定：捏造事实诬告陷害他人，意图使他人受刑事追究，情节严重的，处三年以下有期徒刑、拘役或者管制造成严重后果的，处三年以上十年以下有期徒刑。若构成该罪，必须为特定的人捏造犯罪事实，即无中生有、栽赃陷害、借题发挥，把杜撰的或他人的犯罪事实强加于被害人，所捏造的犯罪事实，只要足以引起司法机关追究被害人的刑事责任即可，并不要求捏造详细情节与证据。再就是必须向国家机关或有关单位告发，或者采取其他方法足以引起司法机关的追究活动。
