释义	法律分析: 建筑物或者其他设施以及建筑物上的搁置物、悬挂物发生倒塌、脱落、坠落造成他人损害的，它的所有人或者管理人应当承担民事责任，但能够证明自己没有过错的除外。法律依据: 《房屋建筑工程质量保修办法》第十四条在保修期内，因房屋建筑工程质量缺陷造成房屋所有人、使用人或者第三方人身、财产损害的，房屋所有人、使用人或者第三方可以向建设单位提出赔偿要求。建设单位向造成房屋建筑工程质量缺陷的责任方追偿。第十五条因保修不及时造成新的人身、财产损害，由造成拖延的责任方承担赔偿责任。
