释义	法律主观：事业单位可以申请设立公司。根据目前《公司法》的规定，我国设立公司有两种形式，即有限责任公司和股份有限公司。对于两种形式的公司，法律未规定其事业单位的限定，因而，只要具备《公司法》的相应条件，事业单位便可以设立有限责任公司或股份有限公司。并且，事业单位成立公司，应依照《中华人民共和国公司登记管理条例》的规定进行登记。《中华人民共和国公司法》第二条　本法所称公司是指依照本法在中国境内设立的有限责任公司和股份有限公司。
