不违法，包租合同只要符合法律规定的，就具有法律效力，所以要依据合同的具体内容才能判断合同是否有效。
法律依据:
《商品房销售管理办法》
第十一条 房地产开发企业不得采取返本销售或者变相返本销售的方式销售商品房。房地产开发企业不得采取售后包租或者变相售后包租的方式销售未竣工商品房。
第四十二条 开发商采取售后包租或者变相售后包租方式销售未竣工商品房的，将由房地产管理部门对开发商处以警告，责令限期改正并可处以1万元以上3万元以下的罚款等行政处罚措施。
