释义	法律分析：人死债消是错误的说法。债务人死亡，债务不能消灭。要追讨债务，首先看债务人是否留有财产，其次看有无债务担保人。一般公民死亡后，有财产的，他的债务由他的继承人承担；无财产的或者继承人放弃继承的，继承人不承担被继承人的债务。法律依据：《中华人民共和国民法典》第一千一百六十一条继承人以所得遗产实际价值为限清偿被继承人依法应当缴纳的税款和债务。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负清偿责任。
