释义	法律分析：初犯一般尚未形成犯罪的习癖，主观恶性不深，可改造性大，人身危险性和社会危害性相对较小，可作为量刑时从宽处罚的酌定情节。但有些初犯实施犯罪时经过长期预谋、犯罪动机卑鄙、手段残酷，犯罪性质严重，对其量刑时就不能从宽处罚有法定或依情可以酌定从重情节的，还要从严惩处。法律依据：《中华人民共和国刑法》第二十七条在共同犯罪中起次要或者辅助作用的，是从犯。对于从犯，应当从轻、减轻处罚或者免除处罚。
