释义	法律分析：不算，不以营利为目的，亲属之间进行带有财物输赢的打麻将、玩扑克等娱乐活动，不予处罚；参与者不满十人，区分不同情形予以裁量和处罚：(一)人均赌资不满1000元的，属于“麻将娱乐”，不予处罚；(二)人均赌资一千以上不满三千元的，处五百元以下罚款法律依据：《中华人民共和国治安管理处罚法》第七十条以营利为目的，为赌博提供条件的，或者参与赌博赌资较大的，处五日以下拘留或者五百元以下罚款;情节严重的，处十日以上十五日以下拘留，并处五百元以上三千元以下罚款。
