土地使用权归开发商还是属于业主
释义
法律分析：土地使用权为开发商原始取得，业主为继受取得。在业主取得产权之前，该房屋并不存在法律意义上的所有权，在业主办理房产证和土地使用证时，该开发商持有的土地使用权要进行分割到户，业主在取得房屋所有权证的同时取得土地使用权证。
法律依据：根据《中华人民共和国城市房地产管理法》第六十条规定：国家实行土地使用权和房屋所有权登记发证制度。
