释义	法律分析：生育津贴按照“就高不就低”的原则发放。也就是说，如果生育津贴低于本人生育休假期间应享受的个人工资标准的，差额部分用人单位必须补足；如果生育津贴高于本人生育休假期间应享受的个人工资标准的，用人单位必须全额发给个人。法律依据：《中华人民共和国社会保险法》第五十六条?职工有下列情形之一的，可以按照国家规定享受生育津贴： (一)女职工生育享受产假; (二)享受计划生育手术休假; (三)法律、法规规定的其他情形。生育津贴按照职工所在用人单位上年度职工月平均工资计发。
