释义	法律分析: 离开用人单位超过2年的，不能要回。劳动监察投诉不能超过2年，仍在用人单位上班的，可以要回。劳动关系存续期内的，不受上面2年的影响。法律依据: 《中华人民共和国劳动合同法》第三十一条加班用人单位应当严格执行劳动定额标准，不得强迫或者变相强迫劳动者加班。用人单位安排加班的，应当按照国家有关规定向劳动者支付加班费。
