释义	法律分析：在判刑之后必须开除党籍，没有要求在判刑前先开除党籍。如果公务员只是被法院认定为有罪，但判决免予刑事处罚，也即没有判处刑罚，则可以不被开除公职。醉驾的公务员，如果能获得法院一个免予刑事处罚的判决，就不会被开除公职。法律依据：《中国共产党纪律处分条例》第三十条有下列情形之一的，应当给予开除党籍处分：（一）因故意犯罪被依法判处《中华人民共和国刑法》规定的主刑（含宣告缓刑）的；（二）单处或者附加剥夺政治权利的；（三）因过失犯罪，被依法判处三年以上（不含三年）有期徒刑的。
