释义	继承人放弃继承的时间，应当在继承开始后至遗产分割前。我国《民法典》第一千一百二十四条规定“继承开始后，继承人放弃继承的，应当在遗产处理前，作出放弃继承的表示。没有表示的，视为接受继承。”并对接受或放弃遗赠作了相应的规定“受遗赠应当在知道受遗赠后两个月内，作出接受或者放弃受遗赠的表示。到期没有表示的，视为放弃遗赠。”因此，放弃继承应当在继承开始后至遗产分割前有效。法律依据《民法典》第一千一百二十四条
