释义	法律分析：构成重婚罪会判刑。重婚罪是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。所谓有配偶，是指男人有妻、女人有夫，而且这种夫妻关系未经法律程序解除尚在存续的，即为有配偶的人；如果夫妻关系已经解除，或者因配偶一方死亡夫妻关系自然消失。既然刑法当中将重婚行为规定为犯罪，重婚罪就必然是被判刑的。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
