释义	法律分析：1、“存疑不起诉”也有叫“疑罪不诉”的，所谓存疑不起诉形似中止，实为终止(或称终结)的决定。 2、“存疑不起诉”不能认定被不起诉人有犯罪事实。 3、我国《国家赔偿法》关于刑事赔偿的原则是适用无罪羁押赔偿原则。法律依据：最高人民检察院《人民检察院刑事赔偿工作规定》第六条人民检察院对于请求赔偿的违法侵权情形，应当依法确认，未经确认有违法侵权情形的赔偿申请不应进入赔偿程序。第7条又规定：有下列法律文书或证明材料的赔偿申请，请求赔偿的违法侵犯人身权情形，以确认论，应当进入赔偿程序。
