释义	公安侦查终结并移交检察院后，检察院也有作出不予起诉决定的情况。人民检察院审查起诉案件，认为犯罪嫌疑人的犯罪事实已经查清，证据确实、充分，依法应当追究刑事责任的，应当作出起诉决定，认为不具备起诉条件的，应当作出不起诉决定。法律依据：《中华人民共和国刑事诉讼法》第十五条下列情形之一的，人民检察院应当作出不起诉决定：第一，情节显著轻微、危害不大，不认为是犯罪的。第二，犯罪已过追诉时效期限的。第三，经特赦令免除刑罚的。第四，犯罪嫌疑人、被告人死亡的。第五，其他法律规定免予追究刑事责任的。
