释义	故意杀人，是指故意非法剥夺他人生命的行为。属于侵犯公民人身权利犯罪。是中国刑法中少数性质最恶劣的犯罪行为之一。我国《刑法》第二百三十二条规定：故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。故意杀人罪是行为犯，只要行为人实施了故意杀人的行为，就构成故意杀人罪。由于生命权利是公民人身权利中最基本、最重要的权利，因此，不管被害人是否实际被杀，不管杀人行为处于故意犯罪的预备、未遂、中止等哪个阶段，都构成犯罪，应当立案追究。
