释义	法律分析：现实生活中,行为人作出意思表示的方式很多,归纳起来大体上可以分为两类:一是以明示的方式作出意思表示。所谓明示的意思表示,就是行为人以作为的方式使得相对人能够直接了解到意思表示的内容。比较典型的是表意人采用口头、书面方式直接向相对人作出的意思表示。二是以默示方式作出的意思表示。法律依据：《中华人民共和国民法典》第四百八十条承诺应当以通知的方式作出；但是，根据交易习惯或者要约表明可以通过行为作出承诺的除外。
