1、致人重伤或死亡的情形。犯罪分子在绑架行为实施过程中，除了非法劫持人质剥夺其人身自由权，有时还造成被害人重伤和死亡结果的发生。是否定绑架罪和故意伤害罪、故意杀人罪，实行数罪并罚？笔者认为，这种情况下，不应按数罪并罚来处理，行为人实施绑架致人重伤、死亡结果的发生有时并不是犯罪分子追求的结果，而是绑架行为的连带行为，这种严重的法律后果并非出于行为人主观上的两种独立的犯意，也非两个独立行为，刑法理论上称之为想象竞合犯，即行为人出于一个故意，实施一种行为绑架殴打致人重伤或死亡。结果触犯数个不同罪名，是想象的数罪而不是实质数罪，应当择一重罪处断，以绑架罪结果犯量刑处罚。因为重伤或死亡作为绑架罪判处死刑的法定情节，作为包容犯可作绑架情节从重处罚
【法律依据】：
《中华人民共和国刑法》 第二百三十九条 绑架罪是指以勒索财物，或者以他人作为人质为目的，使用暴力、胁迫或者其他方法，劫持他人的行为。这里的以勒赎为目的的绑架，是指通过绑架获取人质以后，以一定的方式将绑架人质的事实通知被绑架者的亲属或其他与被绑架者有利害关系的人，并以继续扣押或加害人质等相要挟，勒令其在一定时间内支付一定数额的金钱或其他财物以赎回人质。因此，这种以绑架为手段勒索财物的行为，通常称为绑架勒索。
