释义	法律分析：试用期间解除劳动合同是否需要支付违约金，根据劳动者与用人单位自行协商的结果确定。如果双方订立的劳动合同中有关于试用期间解除劳动合同违约金支付的约定，则从其约定履行；如果劳动者与用人单位对于在试用期间解除劳动合同，没有约定支付违约金或者约定不明确的，则劳动者在试用期间解除劳动合同，仅需要提前三日以书面或者口头形式通知用人单位即可，不需要说明理由。如果是用人单位在试用期间提出解除劳动合同的，则在尽到相应的义务后，劳动者仍不能胜任工作的，用人单位解除劳动者，不需要支付违约金。
