释义	法律分析: 二套房契税按照3%的税率计算，在签订土地、房屋权属转移合同的当天或者取得其他具有土地、房屋权属转移合同性质凭证的当天向契税征收机关进行契税的缴纳。法律依据:《中华人民共和国契税暂行条例》第三条契税税率为3—5％。契税的适用税率，由省、自治区、直辖市人民政府在前款规定的幅度内按照本地区的实际情况确定，并报财政部和国家税务总局备案。
