释义	法律分析: 虐待是指故意折磨、摧残家庭成员，使其在肉体上或精神上蒙受损害，虐待可表现为积极的、作为的形式，也可表现为消极的、不作为的形式。构成虐待的行为如下：打骂、恐吓、限制人身自由、不予衣食、患病不予治疗等。持续性、经常性的家庭暴力，构成虐待。法律依据: 《中华人民共和国刑法》第二百六十条虐待家庭成员，情节恶劣的，处二年以下有期徒刑、拘役或者管制。犯前款罪，致使被害人重伤、死亡的，处二年以上七年以下有期徒刑。
