释义	外观专利10年后，专利权终止，该设计就不受专利保护了。如果外观设计中含有可作为美术作品的图案设计，或者可以作为如雕塑作品或者其它受著作权保护的作品成分，则同时受到著作权的保护。除著作权人外，其他人仍然不能使用该外观专利。法律依据：《专利法》第四十二条发明专利权的期限为二十年，实用新型专利权和外观设计专利权的期限为十年，均自申请日起计算。
