释义
法律分析:
只要劳动者与兼职单位建立的用工关系符合劳动法的规定，原用人单位和兼职单位对劳动者的兼职行为没有异议，一般都认定劳动者与兼职单位之间也存在劳动关系，受劳动法的保护，以符合劳动法所倡导的“维护劳动者合法权益”的立法精神。
法律依据:
《中华人民共和国民法典》 第四百六十五条 依法成立的合同，受法律保护。依法成立的合同，仅对当事人具有法律约束力，但是法律另有规定的除外。
