地铁不属于铁路局，不归铁路局管辖，地铁属于城市轨道客运公司所管辖。
法律依据：
《城市轨道交通运营管理规定》 第五条 城市轨道交通运营主管部门在城市轨道交通线网规划及建设规划征求意见阶段，应当综合考虑与城市规划的衔接、城市轨道交通客流需求、运营安全保障等因素，对线网布局和规模、换乘枢纽规划、建设时序、资源共享、线网综合应急指挥系统建设、线路功能定位、线路制式、系统规模、交通接驳等提出意见。城市轨道交通运营主管部门在城市轨道交通工程项目可行性研究报告和初步设计文件编制审批征求意见阶段，应当对客流预测、系统设计运输能力、行车组织、运营管理、运营服务、运营安全等提出意见。
《关于进一步加强城市轨道交通规划建设管理的意见》 严格建设申报条件，提高申报建设地铁和轻轨的相关经济指标，申报建设地铁的城市一般公共财政预算收入、地区生产总值分别由100亿元、1000亿元调整为300亿元、3000亿元。提高建设规划质量，加强城市轨道交通与其他交通方式的衔接融合，鼓励探索地上地下空间综合开发利用。严格建设规划报批和审核程序，确保建设规模同地方财力相匹配。强化建设规划的导向和约束作用，已经国家批准的建设规划原则上不得变更，进一步明确了规划调整和新一轮建设规划报批条件。
