释义	法律分析: 事实劳动关系的处理： (1)及时签订书面劳动合同。 (2)对不愿订立劳动合同的员工，要立即发出劳动合同限期签订通知书。 (3)事实劳动关系的解除，对于事实劳动关系的解除，主要有两种方式：一是协商一致解除；二是法定解除。协商一致解除是事实劳动关系处理的首选方式，如果协商不能达成一致意见，单方再选择法定解除。法律依据: 《中华人民共和国劳动合同法》第七条用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
