法律主观：
申请办理《 食品经营许可证 》应具备以下条件： 根据食品经营许可管理办法，第十二条申请《食品经营许可证》，应当向申请人所在地县级以上地方食品药品监督管理部门提交下列材料： (一)食品经营许可申请书; (二) 营业执照 或者其他主体资格证明文件复印件; (三)与食品经营相适应的主要设备设施布局、操作流程等文件; (四) 食品安全 自查、从业人员健康管理、进货查验记录、食品安全事故处置等保证食品安全的规章制度。 注意：利用自动售货设备从事食品销售的，申请人还应当提交自动售货设备的产品合格证明、具体放置地点，经营者名称、住所、联系方式、食品经营许可证的公示方法等材料。 申请人委托他人办理食品经营许可申请的，代理人应当提交授权 委托书 以及代理人的 身份证 明文件。 注意事项： 1.县级以上地方食品药品监督管理部门负责本行政区域内的食品经营许可管理工作。各省、自治区、 直辖市 食品药品监督管理部门根据食品类别和食品安全风险状况，确定属地内市、县级食品药品监督管理部门的食品经营许可管理权限，具体规定请参照各地实施细则。 2.食品经营主体业态分为食品销售经营者、餐饮服务经营者、单位食堂。食品经营者申请通过网络经营或者从事集体用餐配送的，申报企业应当在主体业态后以括号标注。 3.提交的申请书与其他申请材料应当使用A4型纸。 4.提交材料未注明提交复印件的，应当提交原件;提交复印件的，应当注明“与原件一致”并由申请人签署，或者由其指定的代表或共同委托的代理人加盖公章或签字。 5、提交材料涉及签署，应使用黑色或蓝黑色钢笔或签字笔签署;未注明具体签署人的，自然人由本人签字;法人和其他组织由其法定代表人或负责人签字，并加盖公章。
