释义	律师解答：单务合同不是民间借贷合同，单务合同，是指一方只享有权利而不尽义务，另一方只尽义务而不享有权利的合同。单务合同的当事人的权利义务不存在对应关系。【法律依据】：《中华人民共和国民法典》第六百五十七条赠与合同是赠与人将自己的财产无偿给予受赠人，受赠人表示接受赠与的合同。第七百条保证人承担保证责任后，除当事人另有约定外，有权在其承担保证责任的范围内向债务人追偿，享有债权人对债务人的权利，但是不得损害债权人的利益。
