释义	法律分析: 工程拿回扣犯法。根据法律规定，发包单位、承包单位及其工作人员在经济往来中，暗中收受各种名义的回扣的，以受贿论，如情节严重，将对单位判处罚金，对于直接负责的主管人员和其他直接责任人员，判处五年以下有期徒刑或拘役。《中华人民共和国建筑法》第十七条发包单位及其工作人员在建筑工程发包中不得收受贿赂、回扣或者索取其他好处。承包单位及其工作人员不得利用向发包单位及其工作人员行贿、提供回扣或者给予其他好处等不正当手段承揽工程。
