释义	合同未生效前能不能退，要依据双方的约定而定，如果双方约定合同未生效可以退的，就能退，如果没有约定当事人退的就构成合同违约。但是因为无效的合同是自始无效的，也就是没有生效，因此有下列情形的合同可以退：(一)一方以欺诈、胁迫的手段订立合同，损害国家利益；(二)恶意串通，损害国家、集体或者第三人利益；(三)以合法形式掩盖非法目的；(四)损害社会公共利益；(五)违反法律、行政法规的强制性规定。法律依据：《中华人民共和国民法典》第一百五十五条无效的或者被撤销的民事法律行为自始没有法律约束力。
