释义	叛逃罪的犯罪主体：依据我国刑法的规定，叛逃罪的犯罪主体是特殊的主体，是指国家机关工作人员，国家机关工作人员在履行公务期间叛逃境外的构成本罪。法律依据：《中华人民共和国》第一百零九条　国家机关工作人员在履行公务期间，擅离岗位，叛逃境外或者在境外叛逃的，处五年以下、、或者;情节严重的，处五年以上十年以下有期徒刑。掌握国家秘密的国家工作人员叛逃境外或者在境外叛逃的，依照前款的规定从重处罚。
