商铺合同没到期押金是否可以退，要视情况而定：
1、承租人与出租人协商解除租赁合同，押金的退还以双方协议为准；
2、出租人违约，导致承租人要求解除合同，押金需要返还，并由出租人承担违约责任；
3、承租人违约，导致出租人要求解除合同，承租人承担违约责任，押金需要返还；
4、合同约定的解除情形或者不可抗力导致合同不能继续履行，按照合同约定办理。
如果租赁合同没有明确押金的性质或者规定，此时押金是作为租赁预付款处理，当承租人与出租人租赁关系解除时，出租人不得以任何理由克扣押金。一般租赁合同会规定押金用于对承租人违约行为的制约，若承租人未出现违约行为，出租人应当返还押金。如果出租人在其与承租人租赁合同解除时非法克扣押金，承租人可先行选择与其协商退还。协商不成，可以选择报警处理，也可以向当地人民法院请求调解或仲裁。

租赁期限六个月以上的，应当采用书面形式。当事人未采用书面形式，无法确定租赁期限的，视为不定期租赁。
