没有签订劳动合同,但是有实习合同。那我该如何办
释义
依据相关法律的规章,实习期不给薪资的,能不能告单位,要依据签订的实习协议而定,如果实习协议有约定薪资的,不给薪资是可以告单位的。实习生与用人单位没有形成劳动关系,用人单位无需按照最低薪资标准支付劳动报酬。法律依据:《中华人民共和国劳动合同法实施条例》第十五条劳动者在试用期的薪资不得低于本单位相同岗位最低档薪资的80%或者不得低于劳动合同约定薪资的80%,并不得低于用人单位所在地的最低薪资标准。
