释义	对新型冠状病毒感染的肺炎患者、疑似病人、密切接触者在其在隔离治疗期间或医学观察期间，企业不得依据劳动合同法第四十条、四十一条与职工解除劳动合同。也就是说，员工在隔离治疗期间或医学观察期间，比照劳动合同法第四十二条规定的疑似职业病诊断和医学观察期间的员工待遇，企业不能以员工不胜任工作或经济性裁员等原因辞退员工。
