释义	法律分析: 不论是当事人申请撤诉还是按撤诉处理的，都会产生一定的法律后果：(1)法院裁定准许撤诉或按撤诉处理，都会直接引起终结诉讼程序的法律后果;(2)诉讼时效重新开始计算，原告在诉讼时效期间内再次起诉的，人民法院应当受理;(3)诉讼费用由原告或上诉人负担。法律依据: 《中华人民共和国民事诉讼法》第一百四十三条原告经传票传唤，无正当理由拒不到庭的，或者未经法庭许可中途退庭的，可以按撤诉处理;被告反诉的，可以缺席判决。
