释义	法律分析：一般情况饭店上错了菜是不会要求顾客付钱的，毕竟是他们上错了。但是严格从法律上讲，顾客知道饭店上错了，应该告知饭店，将上错的菜收回去，不应该吃，要是吃了，其实是构成不当得利的，如果饭店要求付款，法律上是支持的。法律依据《中华人民共和国民法典》第九百八十五条：得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿。
