释义	根据我国现行法律规章，卖淫不属于犯罪行为，而是违反了治安管理处罚条例，一般是处以拘捕和罚款。对卖淫、嫖娼的，可以由公安机关会同有关部门强制集中进行法律、道德教育和生产劳动，使之改掉恶习。期限为六个月至二年。法律依据: 《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘捕，可以并处五千元以下罚款；情节较轻的，处五日以下拘捕或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘捕或者五百元以下罚款。
